    While the implication of Ocasio-Cortez’s claim is that 80 percent of the Rikers population at any given time has not yet been convicted of the crime for which they are presently detained, that is not what she said. Precisely what she said could be interpreted to suggest that 80% of Rikers prisoners have otherwise clean arrest records upon their arrival. An attorney friend of mine who works at The Legal Aid Society in Brooklyn assures me this is not the case.

    His texts to me:

    “In their pending case.”

    “Probably 80-90 percent of Rikers inmates are in on bail, pretrial detention. They’re not serving sentences. That’s true. However, the reason most of them are in on bail is because they have many other criminal convictions and warrants.”

    “Probably 75-90 percent of Rikers inmates have a prior criminal conviction.”

    I don’t know the extent to which it’s our charge to split hairs and argue semantics, so I opted to post this to the talk page rather than make edits to the fact check itself.

    It looks like the new doc NYDC supplied was for all of NY state? Is there one just for Rikers?

    I’ve emailed the New York Department of Corrections requesting official figures on this. Primary sources are really important and referencing them gives WikiTribune’s work much more credibility.
